1. Definitions
The following terms carry the meanings set out below throughout this document:
- "We / Us / Our / Boon Counsel" — Boon Counsel, a legal advisory practice operating from 88/12 Sathorn Road, Silom, Bangkok 10500, Thailand.
- "You / User" — any individual who accesses our website or engages our professional services.
- "Services" — the pension legal advisory services described on our website, including Pension Entitlement Review, Cross-Border Pension Claim Preparation, and Pension Decision Appeal Representation.
- "Website" — our website accessible at booncoun.pro and its subpages.
- "Engagement" — a written agreement to provide specific legal services to a named client, confirmed in a fee letter or instruction acceptance.
- "Content" — all text, documents, graphics, and information published on our website.
2. Acceptance of Terms
By accessing our website or instructing us to act on your behalf, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you should refrain from using our website or engaging our services.
You must be at least 18 years of age and legally capable of entering into binding agreements under applicable law to use our services. We reserve the right to decline to act for any person without providing a reason.
3. Services
Boon Counsel provides pension legal advisory and representation services to individuals in Thailand and to those with pension matters connected to Thai or international pension authorities. Our services are described on our website for general informational purposes only.
Service scope, fees, timelines, and terms specific to your matter are confirmed in writing at the commencement of each engagement. Website descriptions do not constitute an offer to provide services on any particular terms.
3.1 Service Availability
Our services are available to individuals with a legitimate pension matter and no geographic restriction prevents us from acting. We are unable to advise on matters falling outside the scope of our practice area, including general tax advice, property, or commercial law.
4. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate and complete information when submitting enquiries or instructing us.
- Notify us promptly of any change in circumstances that may affect your matter.

Work product prepared specifically for you under an engagement remains yours once payment is received; we retain the right to retain a copy for our own records.
6. Fees and Payment
Fees for our services are set out in the engagement letter issued at the start of each matter. The indicative fees published on our website (denominated in Thai Baht) are subject to confirmation and may vary depending on the complexity of the matter.
6.1 Payment
Payment terms are confirmed in the engagement letter. Where a deposit is required before work commences, this is stated in writing. We reserve the right to suspend work on a matter where an invoice remains unpaid beyond the agreed period.
6.2 Refunds
Fees paid for completed stages of work are not refundable. Where work has not yet commenced on a particular stage, we may agree to a partial refund at our discretion, taking into account preparatory work already undertaken. Refund requests should be submitted in writing to [email protected].
6.3 Currency
All fees are quoted and invoiced in Thai Baht (฿/THB). Where international transfer is required, the client bears any currency conversion or transfer charges.
7. Disclaimers
The information published on our website is provided for general informational purposes only. It does not constitute legal advice and should not be relied upon as such. Legal advice is provided only within the scope of a confirmed engagement, to the named client, for the specific matter described.
We make no representation that outcomes described in illustrative material on our website will be replicated in your matter. The merits of each pension matter depend on its particular facts, and we will discuss our assessment with you honestly and in detail at the outset of any engagement.
We do not warrant that our website will be continuously available or free from error. Access may be interrupted for maintenance or for reasons beyond our control.
8. Limitation of Liability
To the extent permitted by applicable law, Boon Counsel's liability in connection with any claim arising from the use of our website or our services is limited to the fees paid by the client in the relevant engagement.
We shall not be liable for indirect, consequential, or incidental losses — including loss of opportunity or loss of anticipated pension income — arising from any act or omission in connection with our services, unless caused by our own negligence or wilful misconduct.
Nothing in these terms limits our liability for fraud, personal injury caused by negligence, or any other matter that cannot lawfully be excluded.
9. Termination
Either party may terminate an engagement by written notice. Where we terminate, we will provide reasonable written notice and return any documents or materials belonging to the client, subject to any lien for unpaid fees.
Where a client terminates, fees for completed stages of work remain due. On termination, we will provide a written summary of the position of the matter to assist any successor adviser.
Provisions relating to intellectual property, disclaimers, limitation of liability, and governing law survive the termination of any engagement.
10. Dispute Resolution
In the event of a dispute arising from or connected to these terms or any engagement, we ask that you contact us first in writing to attempt informal resolution. We will acknowledge your complaint within 5 working days and aim to respond substantively within 20 working days.
If informal resolution is not achieved, disputes shall be subject to the exclusive jurisdiction of the courts of Thailand, applying Thai law.
11. General Provisions
- Entire agreement — these Terms, together with any engagement letter, constitute the full agreement between us on the matters to which they relate.
- Severability — if any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver — failure to enforce any provision of these Terms on one occasion does not constitute a waiver of the right to enforce it on another.
- Assignment — you may not assign your rights or obligations under these Terms without our prior written consent. We may assign administrative functions within our practice without notice.
- Notices — formal notices should be sent in writing to our registered address or to [email protected].
12. Changes to These Terms
We may update these Terms from time to time. The revised version will be published on our website with an updated effective date. Changes do not affect ongoing engagements, which are governed by the terms in force at the time of instruction unless both parties agree in writing to adopt revised terms.
Continued use of our website following the posting of revised Terms constitutes your acknowledgment of those changes.
